By accessing or using BrightSpark ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a school or organization, you represent that you have the authority to bind that entity to these terms.

2. Description of Service

BrightSpark is an educational platform that allows students to submit game ideas, vote on ideas, and play learning games created from those ideas using AI technology. The Service is designed for use in educational settings.

3. User Accounts

3.1 Teacher Accounts

Teachers must create an account using a valid email address. Teachers are responsible for:

  • Managing classroom access and student membership
  • Moderating student-submitted content
  • Ensuring appropriate use within their classroom
  • Obtaining necessary parental consent for student participation

3.2 Student Accounts

Student accounts are created through teacher-managed classrooms. Students join using a class code and nickname. Students agree not to:

  • Share personal information in their ideas or profile
  • Submit inappropriate, harmful, or offensive content
  • Attempt to access other students' accounts or data
  • Use the Service for any non-educational purpose

4. User Content

4.1 Idea Submissions

When students submit game ideas, they grant BrightSpark a license to:

  • Display the idea to other users for voting
  • Use the idea to generate game content
  • Modify and adapt the idea for educational purposes

4.2 Content Guidelines

All submitted content must:

  • Be appropriate for educational settings
  • Not contain personal information about real individuals
  • Not include hate speech, bullying, or harassment
  • Not contain violent, sexual, or mature content
  • Not infringe on intellectual property rights

4.3 Moderation

BrightSpark reserves the right to remove any content that violates these guidelines. Teachers are the first line of moderation for their classrooms.

5. Intellectual Property

5.1 Our Content

The BrightSpark platform, including its design, code, game templates, and AI-generated content, is owned by BrightSpark and protected by intellectual property laws.

5.2 User Content

Students retain ownership of their original ideas but grant us a license to use them as described above. AI-generated games based on student ideas are owned by BrightSpark.

6. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect user information.

7. Prohibited Uses

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to hack, disrupt, or compromise the Service
  • Create fake accounts or misrepresent your identity
  • Scrape or collect data from the Service
  • Use the Service to distribute malware or spam
  • Interfere with other users' use of the Service

8. AI-Generated Content

Games created by our AI are generated based on student ideas and our templates. While we strive to ensure all content is appropriate:

  • AI-generated content is reviewed but may occasionally contain errors
  • Teachers should preview games before enabling them for their classroom
  • Users can report inappropriate content for review

9. Limitation of Liability

BrightSpark is provided "as is" without warranties of any kind. We are not liable for:

  • Service interruptions or data loss
  • User-generated content
  • Any damages arising from use of the Service

10. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.

11. Termination

We may suspend or terminate access to the Service for violations of these Terms or for any reason at our discretion. Teachers may delete their classrooms and student data at any time.
